The following General Terms and Conditions apply to all orders, offers, deliveries, and services carried out by Marvoproduction.de. They are deemed agreed if no objection is raised immediately prior to order confirmation.
1. The client acquires, as a general rule, a simple (non-exclusive) right of use for a single use.
2. Exclusive rights of use, exclusivity rights, or embargo periods must be separately agreed upon.
3. Marvoproduction.de is entitled to use and publish all created works, in edited or unedited form, without restriction for its own advertising purposes.
4. Upon delivery, only the right of use for the one-time use of the works for the purpose specified by the client is transferred.
5. Any use, exploitation, reproduction, distribution, or publication beyond item 4 is subject to a fee and requires the prior express written consent of Marvoproduction.de.
6. Modifications to the works to create a new copyrighted work are only permitted with the prior written consent of Marvoproduction.de.
7. The client is not entitled to transfer the rights of use granted to them, in whole or in part, to third parties, including other group or subsidiary companies.
8. Any use, reproduction, or distribution of works created by Marvoproduction.de may be permitted by separate, express agreement.
9. Displaying the Marvoproduction.de website in third-party frames requires the express written permission of Marvoproduction.de.
1. For the production of the works, a fee calculated as an hourly rate, daily rate, or agreed flat rate, plus any additional costs plus statutory value added tax, will be charged.
2. Unless otherwise stated, all agreed prices are in euros plus the statutory VAT of 19%.
3. Invoices are, unless otherwise agreed, payable immediately without deduction.
4. The delivered works remain the property of Marvoproduction.de until the purchase price has been paid in full.
5. After order confirmation, the client must pay a deposit of 30% of the agreed gross price. Marvoproduction.de will commence work immediately upon receipt of payment.
6. If the client has not given explicit instructions regarding the design of the works, complaints regarding the artistic interpretation and the artistic-technical execution are excluded.
7. If the client requests changes during or after the production, the client shall bear any additional costs. Marvoproduction.de retains the right to remuneration for work already started.
1. Marvoproduction.de undertakes to carry out the order with the greatest possible care and to treat carefully any objects, templates, films, displays, and layouts entrusted to it.
2. Marvoproduction.de undertakes to store recorded data carefully. Unless otherwise agreed, it is entitled to destroy third-party and its own image files after completion of the order.
3. Marvoproduction.de undertakes to carefully select and instruct any vicarious agents.
4. Marvoproduction.de is liable for the durability and permanence of the storage medium only within the scope of the manufacturer's warranty for the data carrier material. It is not liable for damage caused by improper handling by the client.
5. Retouching and masking work is carried out exclusively by separate agreement and at the risk of the client, unless something else has been expressly agreed.
6. Marvoproduction.de is in principle only liable for its own fault in cases of intent and gross negligence.
7. The dispatch of films, photographs, data carriers, and templates is at the expense and risk of the client, unless otherwise agreed.
8. Complaints about obvious defects must be made in writing by the client within 2 weeks of receipt of the works.
1. The client warrants that it holds the right of reproduction and distribution for all templates handed over to Marvoproduction.de, and, for portraits of persons, the consent of the depicted persons to publication, reproduction, and distribution. The client shall bear any claims by third parties arising from a breach of this obligation.
2. The client undertakes to make the objects to be photographed available in good time and to collect them again immediately after the shoot. If the client does not collect the objects within three working days of being requested to do so, Marvoproduction.de is entitled to charge storage costs or, if its studio space is being blocked, to store the items at the client's expense.
3. Marvoproduction.de undertakes to handle the objects to be photographed with care. It is liable for intent and gross negligence.
1. If Marvoproduction.de provides the client with several works for selection, the client must return the works not selected within one week of receipt, at its own expense and risk. For lost or damaged works, Marvoproduction.de may demand payment insofar as it is not responsible for the loss or damage.
2. If Marvoproduction.de provides the client with works from its archive that were not produced for the client, the client must return the used works within four weeks of receipt. If the client does not return these works despite two requests, Marvoproduction.de may charge a blocking fee.
3. If the time scheduled for carrying out the order is substantially exceeded for reasons for which Marvoproduction.de is not responsible, the fee shall increase accordingly if a flat rate was agreed. If a time-based fee was agreed, Marvoproduction.de shall also receive the agreed hourly or daily rate for waiting time.
4. Delivery deadlines for works are only binding if they have been expressly confirmed by Marvoproduction.de. Marvoproduction.de is only liable for missed deadlines in cases of intent and gross negligence.
5. If the client cancels an order, the following costs apply:
· Up to 10 days before the start of the order: 30% of the agreed costs as per the offer
· Up to 7 days before the start of the order: 50% of the agreed costs as per the offer
· Up to 3 days before the start of the order: 100% of the agreed costs as per the offer.
1. When visiting the Marvoproduction.de website, information about the access (date, time, page viewed) may be stored. This data does not constitute personal data but is anonymized. It is evaluated solely for statistical purposes. No transfer to third parties takes place.
2. Marvoproduction.de expressly points out that data transmission over the internet (e.g. when communicating by e-mail) may have security vulnerabilities and cannot be fully protected from access by third parties.
3. The use of the contact details in the imprint for commercial advertising purposes is expressly not desired, unless Marvoproduction.de has previously given written consent.
4. Personal data of the client required for business transactions may be stored. Marvoproduction.de undertakes to treat all information that becomes known in the course of the order as confidential.
5. Data stored with us will not be passed on to external third parties.
1. The place of performance for all contractual parties for all obligations arising from the contractual relationship is the registered office of Marvoproduction.de.
2. The registered office of Marvoproduction.de is agreed as the place of jurisdiction.
